When people in Florida decide to begin a construction project, they usually take their time to choose a contractor that they believe will do a good job and who quotes them a reasonable price for the project. If a contractor takes a down payment for a particular project, they must obtain all necessary work permits within 30 days of accepting the down payment, unless there are other terms listed in the contract. They also must start the work within 90 days of the necessary permits for the project being issued.
If these time limits are not followed, the owner of the property can make a written demand for the contractor to obtain the permits and start the work or to refund them any money paid in excess of any work actually completed.
If the contractor does not start the work then they must refund the money they received for the project. If they do not the owner may be able to start a lawsuit against the contractor and the contractor may face criminal penalties as well.
